Terms of Service

1. Acceptance of Terms

By signing up for and using MonitorMonk ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Definitions

  • Service: MonitorMonk's uptime monitoring and dashboard (status page) product, including related features we may add in the future.
  • User: Anyone who signs up for an account and uses the Service.
  • Account: A unique login (email + password) created by a User.
  • Dashboard / Status Page: A public web page generated by the Service to show monitoring results.
  • Service Level Agreement (SLA): The availability commitments and service-credit remedies published at , which are incorporated into these Terms by reference and apply as described in Section 10.
  • Monthly Uptime Percentage and Unavailability: As defined in the SLA.

3. Use of Service

  • You must use a valid, non-disposable email address that you check regularly.
  • You are responsible for keeping your account credentials secure.
  • You may use the Service only for lawful purposes.
  • Abuse, spamming, scanning, or interfering with the Service is not allowed.

4. Public Dashboards

Dashboards are public by design. Anyone with the unique dashboard link can see it. You are responsible for the information you choose to display and share.

5. Intellectual Property and User Data

  • MonitorMonk owns all rights in its software, design, and brand.
  • You retain rights to the data you enter (such as website addresses and dashboard names).
  • You grant MonitorMonk a license to process and display this data as needed to provide the Service.

6. Privacy

We collect and use personal data as described in our Privacy Policy. By using the Service, you agree to that policy.

7. Free and Paid Plans

  • MonitorMonk offers a free plan with all features included. Paid plans increase usage limits (e.g. more checks, more dashboards, faster intervals).
  • Paid plans may not always be available.
  • Features and limits are described on our Pricing Page.

8. Payment, Auto-Renewal, and Refunds

  • Paid plans are billed through our payment processor.
  • Subscriptions renew automatically unless canceled through your account before renewal.
  • You can cancel at any time.
  • Payments are non-refundable, except where required by law.

9. Support

Our official support email is [email protected].
We provide support on a best effort basis. No response times or resolutions are guaranteed unless expressly stated in a separate written agreement. Support obligations are separate from the SLA and are not eligible for service credits.

10. Service Availability (SLA placeholder)

MonitorMonk's availability commitments and related remedies are described in the SLA located at , which is incorporated into these Terms by reference. In case of a conflict between these Terms and the SLA regarding availability commitments or service-credit remedies, the SLA controls. Service credits described in the SLA are Customer’s sole and exclusive remedy for any failure to meet the SLA.

11. Termination and Inactive Accounts

  • We may suspend or terminate your account if you violate these Terms.
  • Free accounts with no login and no active dashboards for 90 days may be deleted.

12. Warranty Disclaimers

The Service is provided "as is" and "as available." We make no promises about accuracy, reliability, security, timeliness, availability, or fitness for a particular purpose. We do not guarantee that the Service will be error-free, uninterrupted, or free of harmful code, or that your data will be preserved without loss. Any statutory warranties required by law will apply only to the minimum extent required. Nothing in this Section limits Customer's entitlement to service credits expressly set out in the SLA.

13. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, consequential, punitive, or special damages (including loss of profits, business, goodwill, or data).

Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid to us in the 30 days before the claim, or (b) EUR 50 if you are on the free plan.

We are not responsible for failures or delays caused by events outside our reasonable control, such as internet outages, denial-of-service attacks, hosting provider downtime, natural disasters, war, or other force majeure events.

Service credits under the SLA are the Customer’s sole and exclusive remedy for any failure to meet availability commitments.

14. Indemnification

You agree to defend, indemnify, and hold MonitorMonk harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Service, violation of these Terms, or infringement of others’ rights. We may take over the defense of any matter subject to indemnification, and you agree to cooperate with us in that defense.

15. Governing Law

These Terms are governed by the laws of Hungary, without regard to conflict of law rules.

16. Changes to Terms

We may update these Terms. If changes are significant, we will notify you by email at least 30 days before the new Terms take effect. If you do not agree, you may stop using the Service before the effective date. Continued use means you accept the updated Terms.

17. Severability

If any part of these Terms is found invalid, the rest remain in effect.
